Texas Supreme Court Favors Waco In Suit Over Deadly Cameron Park Fall
The Texas Supreme Court ruled in favor of the City of Waco Friday in a lawsuit filed by the mother of a Baylor student who fell to his death in 2004 from a cliff in Cameron Park.

AUSTIN (November 20, 2009)—The Texas Supreme Court ruled in favor of the City of Waco Friday in a lawsuit filed by Debra Kirwan whose son Brad McGehee fell to his death on April 24, 2004 from a cliff in Cameron Park while watching drag boat races on the Brazos River.
McGehee ignored a warning sign and crossed a wall to sit on the edge of the cliff when the rock beneath him crumbled and he fell about 60 feet to his death.
Kirwan sued in February 2005, alleging that the city was negligent and should have done more to keep park visitors from venturing beyond the existing warning signs and wall.
The trial court dismissed the suit, but a divided 10th Court of Appeals reversed the judgment.
The city appealed to the state Supreme Court, which heard arguments in February.
Waco argued that the city was protected by statute and that negligence could be established only by proving the city created conditions that a recreational user of the park would not have reasonably expected.
The Supreme Court agreed, ruling, “The risks inherent in a natural condition ordinarily will be foreseeable not only to the landowner but also to the recreational user. Even assuming the particular risk at the cliff’s edge – crumbling that gave way – was not necessarily foreseeable, the general risk of a cliff’s edge was.”
At least three people have died in the last five years after falls from cliffs in Cameron Park.
In July 2008, the Waco City Council approved a contract with Austin Filter Systems, Inc. of Austin for $605,000 for the erection of fences made of iron bars, with cement pillars at wide intervals.
City officials said the fences are designed to keep park visitors safer without ruining the view from the park's three cliffs.

Lets blame someone else for the young man who made the choice to IGNORE THE WARNING SIGN and CLIMB OVER A FENCE which are made as warning devices to stop all people from climbing on the clifts. If you cant get the hint of what these things are there for then you probably get what you deserve and this goes in all facets of life..Your right the city did not care and should not have to care.. This happens all the time. So not new news. I haven't been there in a long time, but perhaps they should post a listing of people who cannot follow rules where they climb over the wall to get to the cliff to watch the races. Hey! Maybe we can even post it in many different languages! That will surely help. But in all fairness, this poor woman wanted someone other than her son and perhaps herself (for raising a son who couldn't or wouldn't follow important instruction) for this horrible accident.
LN; You are an idiot.You know nothing about what happened. Because of the rain, the races were not going on.Even if they were,why would the park open access to watch the races along these dangerous areas if their # 1 goal was safety for it's citizens? Why not use common sense and close access to the areas that allowed people to view the races for free? That would be considered protective appropriate action from a responsible city park. Also, would guarantee no free viewing without paying. The races have gone on how many years? The city was irresponsible and negligent, and I am glad they were finally called on it. The city did not care. Inviting people to sit on cliffs with open access was welcoming danger. At age 18-20, risk taking is pretty common.What did you do at this age that was risky and immature? What an insensitive, ignorant person you are.
