Retailers Go To Court In Dispute Over Martha Stewart

NEW YORK (February 20, 2013)—Plano-based J.C. Penney Co. and Macy's Inc. were expected to duke it out in New York State Supreme Court Wednesday over the right to sell Martha Stewart merchandise.

At the heart of the case is whether Macy's has the exclusive right to sell such Martha Stewart branded products as cookware, bedding, and bath items.

Company founder Martha Stewart, J.C. Penney's CEO Ron Johnson and Macy's CEO Terry Lundgren are expected to testify during the trial, which could last about three weeks.

Supreme State Court Judge Jeffrey K. Oing will decide the outcome, not a jury.

In December 2011, J.C. Penney announced entered into a strategic partnership with Martha Stewart to open shops within its stores.
