Three Plead Guilty In $11 Million Texas Health Care Fraud

MCALLEN (February 22, 2013)--A South Texas couple who ran a medical equipment company and a former worker have pleaded guilty in an $11 million health care fraud investigation.

RGV DME owner Marcello Herrera, his wife Carla Cantu Herrera and Ramon De La Garza pleaded guilty to conspiring to defraud Medicare and Texas Medicaid, prosecutors said.

All three are from Mission.

Marcelo Herrera and De La Garza also pleaded guilty to aggravated identity theft in false reimbursement submissions since 2004.

Marcelo Herrera agreed to repay more than $6.1 million; his wife and De La Garza must each make restitution topping $5 million.

The conspiracy count carries a maximum penalty of 10 years in prison.

Aggravated identity has a mandatory two-year prison term.

The Herreras and De La Garza face sentencing later this year.
