Temple Police Officer Assaulted Save Email Print

A | A | A

(May 12, 2008)- A Temple man is charged with aggravated assault on a peace officer after a Temple police officer was attacked just after 11 p.m. Saturday.

Sgt. Gary Smith stopped 47-year-old Barry Garrett while Garrett was walking in the middle of the road in the 600 block of S. MLK Drive, police said.

When Sgt. Smith found out Garrett was named in an outstanding arrest warrant, he tried to arrest the man but police said Garrett resisted and started to hit Smith.

Smith shoulder was dislocated early in the struggle, but police say Garrett continued to strike the injured officer, using a board, sticks and other weapons.

The struggle went from the street into the Cedar creek Lounge, through the bar and out into the back alley before other Temple police officers arrived to help.

Garrett was arrested.

Sgt. Smith was taken to a Scott & White Emergency Room where he was treated for a cut to the head, a dislocated shoulder and bruises and scratches before being released.

Garrett was treated at the scene of the crime for chemical irritation from pepper spray.

He remains in the Bell County Jail.

Dang all the crime that is going on in Killeen you would think their officers would be out there patrolling on booking someone instead of always commenting...Madmax! By the way I have plenty of time to comment cause I am at work and I work on a computer, for those who might be wondering! well madder max, you dont know. You were not there. You can not depcit someones emotions if you were not present during the altercation. Maybe he was, maybe he wasnt. Most people do get a sense of nervousness when the police are present. Espically if they know that they have a warrant. But its cowardly of you to poke fun at a situation that you know absoutly nothing about. If you werent there then dont say anything about it....

Yeah Madmax, shouldnt you be protecting the community? or maybe hiding behind some trees waiting for some one to forget their blinker? i appreciate most police officers that actually protect citizens, and not harrass about stupid things when they are bored. Garrett was probably just scared since a few days earlier, a brotha of his had been beat up on camera by a bunch of coppers.

Madmax are you an officer? You must have alot of time on your hands to comment on these stories b/c I always see your name. Killeen has a lot of crime how do you manage?

Gary is a very good friend of mine. I was on the scene when the call came out. Gary is only guilty of doing is job and doing it well. Many officers check out on people in bars, or walking down the street. And if he or she had an oustanding warrant then it is the officers job to arrest for the warrant (and no it was not a traffic warrant). If u do not like police then why dont you have the courage to call out who you are. Just because you dont have the integrity or honor to be a human being dosnt mean you should criticize those who do. Madmax I agree with everything you say and I completely understand where you are coming from. I understand. Be safe out there, and thank you for your service.

Well Marie, as an Officer, I know the stresses involved. By all means, if an Officer screws up, either by drinking and driving or doing other things, by all means they are on their own, but when one gets hurt or killed by doing right while fighting domestic terrorism, they deserve the respect they have earned. All the negative comments on this board mean nothing. I've been hit on, spit on, faced guns and almost been hit by several cars all for a whopping $43,000 a year.. O trust me, we do it to protect those who cannot protect themselves, even if it means with our life.

At least they arrested him and he did not get away.

Anonymous, is that what you will think when the day comes that you need help. I wonder if anyone will care about you. I guess that is why you don't put your name but we could always change anonymous to coward. Madmax, you are always on here posting positive comments about police officers, thank you for your comments and what you do.

Silly sheep......can't even appreciate a sheepdog. I pray for a speedy recovery for Sgt. Smith.

Sounds like with all the negative comments about the law on here, we know who the criminals are. Thats ok because one day you will be in trouble and who will you call, oh yea, the police... Grow Up!!

Posted by: Madmax Location: Killeen on May 12, 2008 at 04:28 PM
Once again, Mr. Truman believe it or not, Cops get killed on traffic stops. It isn't always about looking for drugs on everybody and thanks for being sarcastic on the 20 cops on a minority. The funny thing is there would never be 20 cops on patrol because they are always short!! hahaha...By the way, try writing a complete sentence...

Posted by: to u trurman on May 12, 2008 at 03:50 PM
u wouldent be getting a ticket if werent breacking the law trueman....

Posted by: truman Location: temple on May 12, 2008 at 03:12 PM
i agree with Waco, usually there are 2-4 cops on someone just for a ticket, hoping for a huge drug bust. and 20 if you are a young minority. i recently knew someone who got their home broken into and it took the cops 4 anda half hours to get there on a sunday morning. thats kind of sad, but they are always there to give you some bullcrap ticket.

Posted by: firecop213 Location: temple on May 12, 2008 at 02:17 PM
Sounds like mr. garrett should be thankful he didnt get shot.

Posted by: Anita Location: Temple on May 12, 2008 at 01:47 PM
Hooray! Another criminal OFF the streets of Temple! Thank you Sgt. Smith and I wish you a speedy recovery!

Posted by: Anonymous Location: Nolanville on May 12, 2008 at 01:29 PM
Wow Rambo Smith. You should check into getting a job in Nolanville. Except that I think they would rather watch a fight than be in one. Too bad for the public.

how ignorant are you slim...

Posted by: WACO1 Location: WACO on May 12, 2008 at 11:56 AM
Garrett probably had a traffic ticket, and Mr. Man in Blue decided he wanted to be a hero. Its a shock to me, that there wasnt 30 cops there to begin with, i have a super clean record and i had 3 just to give me a speeding ticket at lunch time!

Posted by: Mary Location: Cove on May 12, 2008 at 10:11 AM
Slim, what a mean-hearted (not to mention illiterate) thing to say. At least I think I know what you are saying...Let's see, Sgt. Smith shouldn't be trying to arrest someone who has an outstanding warrant on him. Yep, that makes sense. Who are you going to call when someone starts beating on you?

Posted by: Carrie Location: Lampasas on May 12, 2008 at 10:00 AM
I hope Sgt. Smith makes a full recovery. Thank-you for getting one more criminal off the streets to protect all of us! Slim, you are a waste of time, no comment about you!!

Posted by: AKA Location: Texas on May 12, 2008 at 08:45 AM
I hope that Sgt. Smith will make a full recovery. MadMax, I am so glad that someone else feels the way I feel! Some of the people here REALLY need to learn how to spell and write.

Posted by: Anonymous on May 12, 2008 at 08:22 AM
Sounds like the fool,Barry Garret,is lucky to be alive.

Posted by: Madmax Location: Killeen on May 12, 2008 at 06:36 AM
Gary Smith is a personal friend and also a Brother in Blue to me. Glad he is okay. For Slim, who can't even write two proper sentences below; remember, Sgt. Smith fought that criminal to keep him off the streets to protect people like you and me. Also, you might want to go back to school and learn how to write a complete sentence.

Posted by: Ashley Location: Waco on May 12, 2008 at 12:37 AM
GEEZ! That's a hell of a fight!

Posted by: e Location: nuff on May 11, 2008 at 11:42 PM
sounds like Garret is a lucky man. Before Tasers and peppers spray he probably would've been shot. Hopefully Sgt. Smith will be Ok.
