(July 22, 2008)--A judge in Austin has sentenced a woman who admits embezzling more than $1 million from a company to 10 years probation.
State District Judge Charlie Baird told former Applied Products accountant Barbee Tunnell that if she went to prison she couldn't try to repay the money.
The Austin American-Statesman reported Tunnell was prepared to accept a nine-year prison sentence Monday.
Tunnell, 51 apologized in court and agreed to seek substance abuse counseling.
Tunnell was convicted of aggregated theft and aggregated misapplication of fiduciary property.
Prosecutors say Tunnell, from 1996 to 2004, wrote unauthorized checks to herself and others.
Applied Products president Michael Castanon thought Tunnell would serve time, but Castanon, who attended some court proceedings, calls Baird a "compassionate judge" who thinks criminals deserve a break.
