Arrest Affidavits Released in Rosebud Murder
The Falls County Judge on Monday released arrest affidavits in connection with the shooting death of a Rosebud man.

MARLIN (August 03, 2009)-Arrest affidavits released Monday morning by the Falls County Judge indicate the shooting death of 19-year-old Cap Sudduth may have involved drugs.
Sudduth's bullet-riddled body was found July 25 on a gravel road just off FM 1048 outside of Rosebud.
Sudduth had been shot several times in the chest and arms.
The document, signed by Texas Ranger Marquis Cantu, states Sudduth was last seen alive by Terry Marquis Holifield, who told Sudduth he had made arrangements with Jesse Whigham to buy a brick of marijuana.
According to the affidavit, Sudduth arranged to meet Whigham on Falls County Road 314 where the drug deal was to take place.
- In the arrest affidavit, Holifield told Ranger Cantu:
- Holifield he went along with Sudduth to the site at about 6 p.m. but got out of the truck and hid in a roadside ditch because Sudduth had told Whigham he would be alone.
- Holifield said when a second vehicle approached he asked Sudduth who was coming and Sudduth responded it "was Jesse and his girlfriend."
- Holifield said the vehicle Whigham was driving approached Sudduth who was standing on the gravel road.
- As the vehicle approached, Whigham fired several shots though the window, striking Sudduth, Holifield said.
- Holifield explained in the affidavit that Whigham continued driving down the road after the shots were fired.
- Holifield said he then saw Whigham's red Chevrolet Impala SS backing down the roadway towards the place where Sudduth lay and when the car stopped, he heard more gunshots.
Following the shooting, Holifield told Cantu he ran away through a field, the affidavit said.
Brittni Poile, 20, who's charged with capital murder and providing false information to a peace officer in the shooting death of Sudduth, was freed from the Falls County Jail last Thursday after her bond was reduced from $1 million to $52,500.
Whigham, who's also charged with capital murder in Sudduth's death, remained in the Falls County Jail Monday in lieu of $1 million bond, but his attorney, Abel Reyna of Waco, said he plans to seek a reduction in bond.
U.S. Marshals arrested Whigham late last Wednesday as he drove with his attorney and his mother to Falls County to surrender.
