WACO (December 20, 2012)—Samuel Henry, Jr., was named Wednesday in an indictment that charges aggravated assault in connection with an October shooting that left a 7-month-old baby and another man injured.
Henry, 24, was arrested October 17 after a traffic stop for driving with an expired license and possession of crack cocaine and while in the McLennan County Jail was served with additional warrants charging aggravated assault and injury to a child.
Henry remained Thursday in the McLennan County Jail in lieu of bonds totaling $327,500 on multiple charges.
Wednesday’s indictment relates to the Oct. 10 shooting that left Dmar E. Caufield on a ventilator and in very critical condition after surgery at McLane Children's Hospital Scott & White in Temple for a gunshot wound to the head and the baby's uncle, Craig Mays, 38, with shrapnel wounds to the arm.
The infant was flown to Scott & White early in the morning on Oct. 10 after he was shot in the head when somebody fired repeatedly at the house in which he was sleeping at 1609 North 18th St. in Waco.
Information about his condition is not being released, but police confirmed that he is still alive.
Officers who responded to the shooting at around 2 a.m. on Oct. 10 found the infant's mother standing in the front yard of the home with the badly injured baby in her arms.
Because of the severity of the infant's gunshot wound, officers immediately loaded mother and child into a patrol car and took them to Hillcrest Baptist Medical Center.
The baby was then flown to Scott & White.
Mays, who was also asleep inside the house at the time of the shooting, was taken by private vehicle to Hillcrest where he was treated and later released.
Six people including Mays, the infant, the infant's mother and father, and two other children ages, 6 and 10, were in the home at the time of the shooting
"Witnesses described being awakened by gunfire into the home and then discovered the baby and Mays had been shot," Swanton said.
"They did not see anyone nor were vehicles observed at the time of the shooting," he said.
Investigators found at least three bullet holes in the house.
