Court Rejects Texas Death Row Inmate’s Appeal

A Texas death row inmate convicted of killing his estranged wife and drowning her daughter has lost his appeal to the state’s highest criminal court.

HOUSTON (October 5, 2012)--The Texas Court of Criminal Appeals has upheld the conviction and death sentence of Texas death row inmate Gary Green, 41, of Dallas.

He was convicted of stabbing his estranged wife to death and drowning her 6-year-old daughter in a bathtub in September 2009.

Lovetta Armstead, 32, was stabbed more than 25 times in the attack.

Her daughter Jazzmen was drowned.

A second child, a boy, was stabbed in the stomach, but survived.

Green’s attorneys raised 46 points of error from his trial, including challenges to the sufficiency of the evidence against him, his confession and jury selection.

The court rejected all of the claims.

Green could still pursue appeals in federal court.

He does not have an execution date.
