KEMPNER (February 7, 2013)--Negotiation attempts continue between city officials and Gene Doss Construction after hairline cracks, leaks and possible foundation issues were discovered at city hall, built just more than a year ago.
Last fall, city officials and attorneys performed a walk-through in the more than $350,000 building where, according to the city, apparent issues were found.
The building was completed in September of last year and is still under warranty.
However, according to a city spokesperson, Gene Doss Construction expressed the belief that the issues could be weather-related which are not covered under the warranty.
McKamie Kruger LLP, the law firm representing Kempner, filed a petition for a suit in the 27th District Court against the construction company and their performance bond holder.
In January, another walk-through was performed by all parties mentioned in the suit and while a settlement has not been made, city officials said Thursday they are continuing an effort to negotiate.
