Mistrial Declared In Local Child Sexual Assault Trial

A mistrial has been declared in the trial of a Central Texas man charged with aggravated sexual assault of a child.

WACO (October 31, 2012)--Jurors were unable to reach a unanimous verdict Tuesday in the trial of a man accused of aggravated sexual assault of a child.

Judge Matt Johnson declared a mistrial and remanded Glenn Mark Green to the McLennan County Jail where he remains in custody in lieu of a $250,000 bond.

Jonathan Sibley, lead counsel for Green, said the jury reported it was deadlocked 11-to-1 for acquittal and Johnson declared the mistrial.

Sibley said Green was accused of assaulting a 17-year-old girl almost five years ago when she was 12, but the testimony that the victim and others provided during trial was not sufficient to produce a guilty verdict.

Sibley said testimony began Monday afternoon and continued until mid-afternoon Tuesday.

The jury was out about four hours when it reported the deadlock.

"We think it would have been over earlier than that but for the one hold out," Sibley said.

Sibley also said he will file a motion to reduce Green's bond in light of what happened in court Tuesday. Green has been in custody for 519 days according to the court's docket.

The district attorney's office has not yet said if prosecutors will take the case back to court.
