Waco: Jury Rules Against Appraisal District In Breach Of Contract Suit

WACO (November 15, 2012)—A Waco state district court jury returned a $503,242 judgment Thursday in a breach of contract lawsuit filed by Hoppenstein Properties against the McLennan County Appraisal District.

The company’s attorney, Jim Dunham of Waco, said the suit stemmed from the appraisal district’s decision to move out of the building it had occupied since 1981 at 600 Columbus after signing a 5-year lease in 2007 that was to kick in after renovations were completed in 2008.

The appraisal district wasn’t happy with the progress of the work, however, and moved out in 2009, purchasing a building on South 26th Street.

The company filed the suit that same year seeking the lost revenue from the rent and some of the expense of the renovations, but State District Judge Jim Myer ruled in favor of the appraisal district.

The 10th Court of Appeals later overturned the decision, however.
