WACO (February 12, 2013)--U.S. District Judge Walter S. Smith Tuesday declared a mistrial in a case that involved what prosecutors said was the illegal purchase of a firearm.
Adam Delaskie Lennington was charged with making a false statement in the acquisition of a firearm.
Jurors deliberated for a total of three hours, but on Tuesday at around 10 a.m. reported to Smith they could not reach a unanimous decision as to Lennington's guilt.
Prosecutors presented evidence during their case that Lennington falsified a document he completed while making the purchase and failed to report he was buying the gun for someone else.
At some point after the sale, the gun was tied to an accidental shooting that resulted in a person's death.
But the defense was able to persuade the jury that Lennington did not intentionally falsify the document, rather just made an error.
Waco attorney Scott Peterson represented Lennington.
In light of the mistrial order, the government could choose to retry the case at a later date.
