WACO (January 9, 2013)--A Waco man arrested in December after an incident in which a man was beaten with a claw hammer was named in a multi-count indictment Wednesday.

Michael Jason Portillo, 36, was indicted for burglary of a habitation with intent to commit aggravated assault with a deadly weapon and two counts of aggravated robbery.

Waco police Sgt. W. Patrick Swanton said officers were sent at around 3:30 a.m. Dec. 1, 2012 to a residence in the 2300 block of Washington Avenue after police received a 911 call about a 36-year-old man being beaten with a hammer.

When officers arrived a 33-year-old woman told them her estranged husband had come into the residence while she and the other man were asleep and began beating the man with a claw hammer.

The woman also reported she was pushed.

The attacker had fled, but officers found him outside the residence and tried to arrest him.

The suspect, who Swanton said was 5-feet, 6-inches tall and weighed about 330 pounds, resisted arrest and attempted to pull two knives out of his pockets and attack officers.

The officers at the scene used a stun gun to bring the suspect under control and handcuffed him.

The man who was attacked had a gash on his head but he refused medical attention, Swanton said.

Portillo remains in the McLennan County Jail in lieu of bonds totaling $250,000.
