Waco: Man Sentenced For Selling Drugs Near Playground

WACO (September 12, 2012)-A McLennan County man was sentenced Wednesday in Waco to federal prison after he earlier pleaded guilty to possession of methamphetamine with intent to distribute within 1000 feet of a playground and to possessing a firearm during the commission of a drug crime.

U.S. District Judge Walter S. Smith sentenced Julian Pena Garcia to 97 months on the methamphetamine charge and an additional 60 months on the weapons charge to be served consecutively.

Smith also ordered Garcia to serve five years on supervised release after he completes his prison sentence, ordered him to pay a $1,000 fine and a $200 special assessment to the court.

A federal grand jury indictment says Garcia and his co-defendant possessed at least 50 grams of methamphetamine and were selling the drug out of a residence that was within 1,000 feet of a playground.

When they were arrested, the indictment states, both were found with handguns, which resulted in the second charge.
