CORPUS CHRISTI (July 26, 2009)--Police can arrest people who don’t leave town under mandatory evacuation orders under a new state law that goes into effect in the heart of Texas' hurricane season.
The law was passed this year and is effective Sept. 1.
It also applies to other disasters, such as fires or floods.
As it stands, officials cannot compel people to evacuate, only warn that those who stay behind won't have any emergency services at their disposal.
The Corpus Christi Caller-Times reports the new law gives county judges and mayors the power to authorize use of "reasonable force" to remove people from the area.

I've now lived long enough to see legislative cowardice in action. Perhaps some of those same police who use the law to remove citizens from their homes will be the same police who loot after the storm passes as what happened here in and around New Orleans after Katrina. I'll never forget. And I'm glad I stayed. I still have my property.

Those 'less government' republican's at it again. Seems like they like less government when it affects their businesses, but don't mind it when it comes to individual liberties. People for this are the same people that are willing to give up their liberties to feel safe.

I am all for our rights especially in Texas. I want us to succeed but I don't think that will happen. BUT I do understand the need for theis law. When those people stay and then then they get scared because the hurricane is hitting them and "it won't be that bad" was the excuse for staying and they then want "rescued" it puts the lives of smarter individuals at risk. I say they just should have left it at we won't come get you if we told you to get out so sorry but you are on your own. If you make it great if not sorry we told you to get out. I think having a law may prevent lawsuits since everyone wants to sue somebody for something. At least this way they can say we told you to get out and you chose to stay that's on you and hey look we didn't arrest you like we could have according to the new law so what more can you ask for.
