HAMILTON, Ohio (March 26, 2013)—Ohio County Prosecutor Mike Gmoser, who lightheartedly filed a criminal indictment against the famous Pennsylvania groundhog Punxsutawney Phil for fraudulently predicting an early spring says he has dismissed the charge.
Gmoser said Phil has a defense now that the animal's handler is taking the blame.
Last week Gmoser issued an indictment as winter-like weather continued across much of the nation, even as spring officially began.
Gmoser said the tongue-in-cheek indictment generated a lot of attention, but said he has a lot of "really serious work" to do and wanted to end things on a positive note.
