FALLS COUNTY, Texas (KWTX) The results of the investigation of a weekend shootout between two Falls County men that left one dead and one injured will be forwarded to prosecutors to take before a grand jury for review, Falls County Sheriff Ricky Scaman said Tuesday.

“No charges will be filed in the case until after District Attorney Jody Gilliam takes a look at the case and then takes it before a grand jury,” he said.

Roger Ross, 59, died after he was hit repeatedly in the lower part of the body during the shootout Sunday afternoon, authorities said.

The other man, Tim Haigood, 55, was flown to Scott & White Medical Center in Temple.

He was released on Monday, Scaman said.

The Falls County Sheriff's Office said the altercation between the two men happened at around 2 p.m. Sunday on County Road 247 just east of Marlin.

"We believe the two were arguing over some dead livestock along a bordering fence line," Scaman said.

An investigation is ongoing with the Texas Rangers assisting.

No charges have been filed.
